Former President Joe Biden’s doctor refused to testify before Congress in a closed-door interview Wednesday citing doctor-patient privilege and his Fifth Amendment rights. The House Oversight and Government Reform Committee issued a subpoena for him last month to testify about the 46th president’s declining health throughout his term.
Kevin O’Connor, who served as Biden’s physician while in the White House, had his legal counsel provide a statement on his behalf. His attorneys explained in the statement that they advised him not to speak before Congress because of the “unique circumstances of this deposition.” O’Connor showed up to Capitol Hill as required by Congress but left less than an hour into the interview without answering any questions.
In their statement, O’Connor’s attorneys quoted President Donald Trump as stating that only “an absolute fool” would not use his Fifth Amendment rights. The quote was in reference to New York Attorney General Letitia James launching a controversial investigation into the president’s businesses that he referred to as a “witch hunt.”
House Oversight and Government Reform Committee Chairman James Comer (R-Ky.) blasted O’Connor for refusing to testify in a post on X.
“It’s now clear there was a conspiracy to cover up President Biden’s cognitive decline after Dr. Kevin O’Connor, Biden’s physician and family business associate, refused to answer any questions and chose to hide behind the Fifth Amendment,” Comer said. “The American people demand transparency, but Dr. O’Connor would rather conceal the truth. Dr. O’Connor took the Fifth when asked if he was told to lie about President Biden’s health and whether he was fit to be President of the United States.”
In the letter accompanying O’Connor’s subpoena in June, Comer explained that the committee wanted to know if the doctor’s “financial relationship” with Biden’s family affected his assessment of the former president’s “physical and mental fitness to fulfill his duties as President.” Comer said that the purpose of O’Connor’s testimony was to determine if he “contributed to an effort to hide former President Biden’s fitness to serve from the American people.”
The committee is currently investigating Biden’s mental health as president. As part of this investigation, Comer has also asked other top Biden administration officials to speak before Congress, including former White House Chief of Staff Ron Klain, Senior Advisor Anita Dunn, and Counselor to the President Steve Ricchetti.
Conservative radio host Clay Travis argued on X that the coverup of Biden’s health should be treated similar to how Democrats treated the people who participated in the January 6, 2021, riot at the U.S. Capitol.
“There should be prime time hearings on the Biden health cover up just like Democrats did for January 6th,” Travis said. “Make every station cover it live. Put every staff member and the doctor under oath. Grill them for their lies and the cover up. Do it in August when nothing else is on TV.”
The committee has additional ongoing investigations into Biden as well. Comer is leading investigations into the Biden family’s business dealings, the Biden family’s influence peddling, and the border crisis during the Biden administration.
